Type of Divorce: Uncontested or Contested
At the heart of every divorce, whether contested or uncontested, there are several issues that must be addressed:
- Custody of minor children
- Child Visitation
- Child support
- Division of assets and debts
- Alimony
- Grounds for the divorce
In an uncontested divorce, the parties are in agreement as to all the issues that must be addressed. In an uncontested divorce, both the husband and wife agree to a divorce, and enter into a written agreement on the rights and duties as to the other issues of the divorce. Once the agreement is signed, it will be submitted to the Court along with t
he other required paperwork. The Judge will then wait the required amount of time and enter the Judgment of Divorce.
In a contested divorce, the husband and wife are unable to reach an agreement as to one or more of the issues that must be addressed in a divorce. In this case the divorce will be filed with the Court and the case will be set for trial. The parties must then take the necessary steps to prepare their case for trial and present their case at trial. After hearing the case, the Judge will decide all the pertinent issues based on evidence presented at trial.
