Negligent Misrepresentation as a Marital Tort

Former husband of child’s mother filed a common-law negligent representation suit against his ex-wife based on his assertion that she had intentionally misled him to believe that he was the biological father. Tennessee Supreme Court indicated that the damage award based on the post-divorce payments for the child’s expenses was not an improper retroactive modification of support, and stated that intentional misrepresentation encompases the claim made by the husband.
